The obligation
What a covered project may require
Section 3 is not a form you sign once. Depending on the recipient and contract, compliance may require a pre-award or pre-agreement plan, ongoing labor-hour records, worker and business documentation, subcontractor records, outreach evidence and reports on a stated cadence — all retained under the project's recordkeeping requirements.

Housing rehabilitation, housing construction and other public construction projects where total assistance to the project exceeds $300,000. Threshold raised from $200,000 effective March 16, 2026. |

| Public housing financial assistance |
No project-dollar threshold applies. Any covered public housing financial assistance triggers Section 3 requirements, including covered development assistance, operating funds, capital funds and mixed-finance development. Performance is measured using assisted labor hours in the PHA's or other recipient's fiscal year. |
| Scope |
For a housing and community development project above the applicable threshold, the requirements apply to the entire project, whether it is fully or partially assisted. Applicable duties extend to contractors and subcontractors through the governing agreements; contracts solely for materials are exempt. |
| Section 3 workers |
25% or more. For housing and community development projects, the denominator is all labor hours worked on the project. For public housing financial assistance, it is all labor hours funded by that assistance in the PHA's or other recipient's fiscal year. |
| Targeted Section 3 workers |
5% or more using the applicable denominator above. Targeted Section 3 worker hours are included within, not added on top of, the 25% Section 3 worker benchmark. |
| Miss either benchmark |
The recipient must report the qualitative nature of its Section 3 activities in the manner HUD requires. Contractors and subcontractors provide the recipient with labor-hour data and evidence of actual outreach and other efforts as their agreements require. |
Meeting both benchmarks and certifying that the required prioritization of effort was followed establishes the regulatory safe harbor, absent contrary evidence. If either benchmark is missed, documented qualitative efforts may demonstrate compliance; reporting a checklist without the underlying work and evidence does not create the safe harbor.

A running ledger of total hours, Section 3 hours and Targeted Section 3 hours across the required tiers, reconciled to approved time-and-attendance records and, where applicable, certified payroll.

We chase the required worker documentation, business concern documentation and scheduled submissions from your subs so your PM is not the collections department.

Reports prepared in the funder's format at the cadence your contract requires, with the underlying support organized for client review and timely submission. Bibbs submits directly only when expressly authorized.

Bibbs Technology provides administrative documentation and reporting support, not legal, accounting, payroll or certified-payroll services. The recipient, developer or general contractor remains responsible for confirming applicability, approving worker and labor-hour classifications, verifying source information, signing or submitting required reports, and satisfying the governing contract and HUD requirements.

Who performs the work can matter to your numbers
Eligible, documented Bibbs project hours can contribute to a project's Section 3 and Targeted Section 3 totals when the recipient accepts the individual worker's status and supporting records. The City listing creates access; the recipient determines the labor-hour credit.
